Our client was prosecuted in the Magistrates’ Court by DVSA for a total of six offences relating to driving without a tachograph inserted, which meant that the daily rest was too short by a number of hours. This was initially charged as False Record / Fraud offences, but the Prosecutor agreed to reduce these to Fail to Record.
The Court has powers of an unlimited fine, or to commit to the Crown Court for consideration of a custodial sentence of up to 2 years.
However, following detailed mitigation presented by Transport Solicitor Laura Newton, the Court agreed that the case could be dealt with by a fine of £153 on the first offence, and no separate penalty on the other charges, which was very lenient in the circumstances.
